Key points: WebTalk is provided free of charge. You must use it lawfully and not abuse the service. We may update these terms with notice. English law governs this agreement.
These Terms of Service ("Terms") govern your use of the WebTalk live chat platform ("Service") operated by Aqua Networks Limited ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
WebTalk provides a live chat widget ("Widget") and administration dashboard ("Dashboard") that allows businesses to communicate with visitors on their websites. The Service includes:
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction. You must notify us immediately of any unauthorised access to your account.
You agree not to use the Service to:
When using the Widget to collect data from your website visitors, you are the data controller for that end-user data. You are responsible for ensuring you have a lawful basis to collect and process such data and for maintaining an accurate privacy notice on your website. We process end-user data on your behalf as a data processor. Our Privacy Policy describes how we handle data.
The WebTalk platform, including its software, design, and documentation, is owned by Aqua Networks Limited and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. You retain all rights to your own content (conversation data, user data) that you input or generate through the Service.
We aim to provide a reliable service but do not guarantee 100% uptime. The Service is provided "as is". We may perform maintenance that results in temporary unavailability. We will endeavour to provide advance notice of planned maintenance where possible.
To the maximum extent permitted by law, Aqua Networks Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim (or £100 if no payment has been made).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You may close your account at any time. We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity of the breach. Upon termination, your data will be deleted in accordance with our Privacy Policy.
We may modify the Service or these Terms at any time. We will notify registered users of material changes by email at least 14 days in advance where practicable. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you may also benefit from mandatory consumer protection provisions in your country of residence.
